Consent Order

A discipline committee of the Real Estate Council of British Columbia (the “Council”) accepted the Consent Order Proposal submitted by Jin Wei Luo (“Mr. Luo”) on his own behalf, and on behalf of Jin Luo Personal Real Estate Corporation (“JL Personal Real Estate Corporation”), and found that Mr. Luo and JL Personal Real Estate Corporation committed professional misconduct when they:

1. permitted a buyer to sign an offer a property on behalf of a group of buyers without taking sufficient steps to determine whether the buyer had the lawful authority to sign the offer on behalf of the group;
2. permitted a buyer to sign an offer for another property (Property B) on behalf of a group of buyers without taking sufficient steps to determine whether the buyer had the lawful authority to sign the offer on behalf of the group;
3. failed to promptly disclose to the group of buyers the remuneration paid or payable to Mr. Luo’s related brokerage in relation to the real estate services they provided to the buyers when they failed to disclose Mr. Luo's obligation to pay a referral fee to the sellers of Property B;
4. failed to take reasonable steps to avoid a conflict of interest when Mr. Luo agreed to pay a referral fee to the sellers of Property B; and
5. ​​​​​​​failed to promptly and fully disclose to the buyers the conflict of interest which arose when Mr. Luo agreed to pay a referral fee to the sellers of Property B.

Results

A discipline committee of the Council has ordered, and Mr. Luo has agreed to, the following penalties:

1. a suspension of 14 days (from May 5, 2021 to May 18, 2021, inclusive);
2. a discipline penalty of $5,000;
3. enforcement expenses of $1,500; and
4. successful completion of the Real Estate Trading Services Remedial Education Course.
