BCFSA Issues $140k In Penalties for Unlicensed Rental Property Management Services
Two individuals in separate investigations provided rental property management services for a total of 20 B.C. properties without being licensed to do so.
BCFSA has ordered Glenn Campbell to pay a $100,000 discipline penalty and $25,805.26 in enforcement expenses for misconduct relating to unlicensed activity. In a separate, unrelated investigation for similar misconduct, BCFSA has levied a $40,000 discipline penalty and $13,107.59 in enforcement expenses against Kirsten Scoffield.
Campbell provided rental property management services for 17 properties in Surrey, Langley, and White Rock, B.C. without being licensed to do so under the provisions of the Real Estate Services Act (“RESA”), and without being exempt from licensing requirements under RESA. Scoffield provided rental property management services for three properties in Vancouver, B.C. without a licence or exemptions from licensing requirements under RESA.
“Unlicensed activity puts the public at considerable risk and BCFSA considers these incidents to be serious,” said Jonathan Vandall, Vice President, Compliance and Enforcement at BCFSA. “The penalties issued against Campbell and Scoffield demonstrate that BCFSA does not tolerate actions that undermine the integrity of the real estate industry in B.C., show a disregard for the regulatory regime, or put B.C. real estate consumers at risk.”
BCFSA found that Campbell likely received more than $80,000 for providing rental property management services from at least 2013 to 2022. Campbell freely admitted to being an unlicensed rental property manager at the time he provided such services, and he continued to provide such services after having been advised by BCFSA of the complaint regarding his unlicensed activity.
Scoffield provided rental property management services from at least 2012 to 2017. While her total unlicensed activity earnings are unknown, evidence before BCFSA indicated that she earned at least $20,000 in remuneration. The sanctions against Scoffield also reflect the seriousness of providing unlicensed real estate services and the length of time that misconduct occurred.
Both Campbell and Scoffield withheld or concealed information required for BCFSA’s investigation. Campbell failed to respond to an information request in 2020 related to the investigation into his unlicensed activity, while Scoffield stated to BCFSA that she had not provided rental property management services, when that statement was not true.
