Summary
Mr. Xu committed professional misconduct when he failed to keep his managing broker informed of the real estate services he was providing and other activities being performed, specifically, that he was being referred clients by immigration settlement companies and was paying them referral fees.
Results
A discipline committee of the Council has ordered the following:
- Mr. Xu is reprimanded and his licence suspended for 30 days, from November 14, 2018 to December 14, 2018, inclusive. He is prohibited from acting as an unlicensed assistant during his licence suspension period.
- Mr. Xu must pay a discipline penalty of $1,500 to the Council.
- At his own expense, Mr. Xu must successfully complete the Real Estate Trading Services Remedial Education Course.
- Mr. Xu must pay enforcement expenses of $1,500 to the Council.
As Mr. Xu has a personal real estate corporation, the licence of Tony Xu Personal Real Estate Corporation is also reprimanded and equally responsible for paying the discipline penalty and enforcement expenses.
