Summary
REAL ESTATE COUNCIL OF BRITISH COLUMBIA DISCIPLINE DECISION
In the matter of the Real Estate Services Act
S.B.C. 2004 ch. 42
AND in the matter of a Consent Order pursuant to Section 41 of the Real Estate Services Act
Issue: Tariq Altaf Kassam, whose licence is currently inoperative, entered into a Consent Order with the Council that, while licensed as a representative with 2 Percent Realty Turbo Inc., Vancouver, he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act in that he:
- contravened section 7(3)(a) of the Real Estate Services Act, while licensed with 2 Percent Realty Turbo Inc. by providing real estate services other than on behalf of his brokerage in that he provided real estate services through an unlicensed entity, West Coast Living Real Estate Services, of which he was the sole proprietor;
- contravened section 27(1)(a) of the Real Estate Services Act in that on or about July 16, 2013 he received a rental deposit bank draft in the amount of $3,250.00 from WZ made payable to West Coast Living Real Estate Services for rental of property on West Cordova Street in Vancouver and he failed to promptly pay or deliver these deposit funds to his brokerage; and
- contravened section 2-19 of the Council Rules in that he failed to promptly respond to the written inquiries by the Council concerning information with respect to West Coast Living Real Estate Services.
Results
Tariq Altaf Kassam was subject to an Order of a discipline committee that:
- his licence be cancelled until it expires on May 21, 2014;
- should he apply for relicensing after May 21, 2014, he be subject to a qualification hearing to determine his suitability for licensing;
- should he be found suitable for licensing by a qualification hearing committee after a qualification hearing, as a condition of relicensing, he, at his own expense, register for and successfully complete the Rental Property Management Remedial Education Course; and
- as a further condition of relicensing he pay enforcement expenses to the Council in the amount of $1,250.00.
